Terms of Service

These Terms govern your use of the Have We Met? iOS application and this website (together, the "Service"), operated by Have We Met LLC ("we", "us"). By using the Service you agree to these Terms and to our Privacy Policy. If you don't agree, don't use the Service.

1. What the Service is

Have We Met? compares the location and time metadata of two consenting users' photo libraries to surface moments their paths nearly crossed, and lets each user optionally reveal selected photos to the other within a private session.

2. Eligibility

You must be at least 16 years old (or older where your local law requires) and legally able to accept these Terms. By using the Service you confirm both.

3. Your license to use the app

We grant you a personal, non-exclusive, non-transferable, revocable license to install and use the app on Apple-branded devices you own or control, as permitted by the App Store Terms of Service. All rights not granted are reserved. You may not copy, modify, distribute, sell, reverse-engineer, or attempt to extract the source code of the Service except where the law permits it despite this restriction.

We may suspend or terminate access for violations. Misuse aimed at another person's safety is grounds for immediate termination.

7. Termination

You can stop using the Service at any time and request deletion of your data (see Delete your data). We may suspend or terminate the Service or your access to it for violation of these Terms, or discontinue the Service entirely with reasonable notice. Sections 4 (license end), 8–11 survive termination.

8. Disclaimers

The Service is provided "as is" and "as available." Matches are computed from the metadata your photos happen to carry: they can be incomplete, imprecise, or wrong (clocks drift, GPS wanders, libraries lose data). We make no warranty that results are accurate or complete, that the Service will be uninterrupted or error-free, or that any particular moment reflects an actual near-meeting. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

9. Limitation of liability

To the fullest extent permitted by law, we will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising from your use of the Service — including consequences of information you or your partner chose to share within a session. Our total liability for all claims relating to the Service will not exceed the greater of the amount you paid us in the past twelve months and fifty US dollars. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

10. Indemnity

You will indemnify and hold us harmless from claims arising out of content you reveal, your misuse of the Service, or your violation of these Terms or of another person's rights.

11. Governing law

These Terms are governed by the laws of the United States and the state of the operator's principal place of business, without regard to conflict-of-law rules. Courts located there have exclusive jurisdiction, and you and we each waive objections to that venue, except where your local consumer law grants you a different forum.

We may update these Terms; material changes will be noted in the app and by updating the effective date above. Continued use after a change means the updated Terms apply.
