Terms of Service
Effective August 31, 2026
These Terms govern your use of the Have We Met? iOS application and this website (together, the "Service"), operated by Have We Met LLC ("we", "us"). By using the Service you agree to these Terms and to our Privacy Policy. If you don't agree, don't use the Service.
1. What the Service is
Have We Met? compares the location and time metadata of two consenting users' photo libraries to surface moments their paths nearly crossed, and lets each user optionally reveal selected photos to the other within a private session.
2. Eligibility
You must be at least 16 years old (or older where your local law requires) and legally able to accept these Terms. By using the Service you confirm both.
3. Your license to use the app
We grant you a personal, non-exclusive, non-transferable, revocable license to install and use the app on Apple-branded devices you own or control, as permitted by the App Store Terms of Service. All rights not granted are reserved. You may not copy, modify, distribute, sell, reverse-engineer, or attempt to extract the source code of the Service except where the law permits it despite this restriction.
4. Your content
- You own your photos and your data. We claim no ownership of anything from your photo library.
- You grant us a limited license to process your photo metadata, and to store and transmit photos you choose to reveal, solely to operate the Service for you and your paired partner.
- You are responsible for the content you reveal. Only reveal photos you have the right to share, and only content that is lawful.
- This license ends when the underlying data is deleted from the Service.
5. Pairing and shared results
- A session connects exactly two users who each chose to join it. By joining a session, you understand that matched places, dates, and distances from your library will be visible to your partner — that is the product.
- Session results are inherently shared: deleting a session removes it for both participants.
- Keep your session code private. Anyone holding the code before pairing completes can join as your partner.
6. Acceptable use
You agree not to:
- use the Service to stalk, harass, track, or intimidate anyone, or to establish someone's whereabouts without their knowledge and consent;
- join a session under false pretenses or pair with someone else's device or library without their consent;
- reveal photos that are unlawful, infringing, or that depict third parties in ways that violate their rights;
- redistribute a partner's revealed photos or matched locations beyond the uses the app itself provides, without their consent;
- probe, scrape, overload, or interfere with the Service, or access it by any means other than the app and this website.
We may suspend or terminate access for violations. Misuse aimed at another person's safety is grounds for immediate termination.
7. Termination
You can stop using the Service at any time and request deletion of your data (see Delete your data). We may suspend or terminate the Service or your access to it for violation of these Terms, or discontinue the Service entirely with reasonable notice. Sections 4 (license end), 8–11 survive termination.
8. Disclaimers
The Service is provided "as is" and "as available." Matches are computed from the metadata your photos happen to carry: they can be incomplete, imprecise, or wrong (clocks drift, GPS wanders, libraries lose data). We make no warranty that results are accurate or complete, that the Service will be uninterrupted or error-free, or that any particular moment reflects an actual near-meeting. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
9. Limitation of liability
To the fullest extent permitted by law, we will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising from your use of the Service — including consequences of information you or your partner chose to share within a session. Our total liability for all claims relating to the Service will not exceed the greater of the amount you paid us in the past twelve months and fifty US dollars. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
10. Indemnity
You will indemnify and hold us harmless from claims arising out of content you reveal, your misuse of the Service, or your violation of these Terms or of another person's rights.
11. Governing law
These Terms are governed by the laws of the United States and the state of the operator's principal place of business, without regard to conflict-of-law rules. Courts located there have exclusive jurisdiction, and you and we each waive objections to that venue, except where your local consumer law grants you a different forum.
12. Apple-specific terms
- These Terms are between you and us — not Apple. Apple has no obligation to furnish maintenance or support for the app.
- In case of the app's failure to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation.
- Apple is not responsible for addressing claims relating to the app, including product liability, regulatory compliance, or IP claims.
- You represent that you are not located in an embargoed country and are not on any US government restricted-party list.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
13. Changes to these Terms
We may update these Terms; material changes will be noted in the app and by updating the effective date above. Continued use after a change means the updated Terms apply.
